ISLAMABAD: Jail authorities have failed to follow the direction of the Islamabad High Court (IHC) for the preparation of Pakistan Tehreek -e -Insaf (PTI) founder Amran Khan on Friday.
During the case of Mashal Yousafzai, the court directed the Adiala Jail Superintendent to meet the PTI founder and confirm whether Yusufzai was his legal representative.
Initially, during today’s hearing, the court remarked that if they intend to move forward with the appearance of the Advocate General (AG) video link, they must be aware of it. However, if the PTI founder has not been presented through a video link up to 2PM, he has to be personally brought to the court at 3pm.
After the expiry of the deadline of 2PM, the former prime minister was to be presented in court, in accordance with court orders.
However, Islamabad Advocate General (AG) informed the court that it was not possible to bring the PTI founder from jail due to security concerns and it was not possible to present it through a video link.
The court directed Adiala Jail Superintendent and Islamabad IG to submit their affidavits in this regard.
The court has also constituted a commission to visit Law Clerk Sakina Bangash to Adiala Jail and confirm the PTI founder whether Yusufzai was his lawyer or not. The Commission, which includes the Law Clerk, has been directed to meet Khan tomorrow (Saturday), and the jail superintendent has been directed to arrange for the meeting.
On this, Yusufzai said that the formation of the Commission is a golden opportunity for him. He also requested that the commission asked if the PTI founder is allowed to meet his friends.
Islamabad AG then said that the court order was not related to friends, but with meetings with lawyers.
Justice Sardar Ejaz Khan remarked that Yusufzai was appearing in court as a lawyer, and the court is hearing the petition accordingly.
Earlier, the court remarked that the failure to comply with a previous court order, which was issued with the consent of all parties, is equivalent to contempt of court. At the previous hearing, the court had ordered that the applicant be allowed to meet the PTI founder.
Expressing disappointment, the judge said that the jail authorities are expected to follow the court’s direction. He remarked, “Lovely, the court believes that the jail authorities have insulted.”
The court also noted that a list was presented, provided by the PTI founder. However, if the court is not satisfied with its authenticity, it will directly confirm it.
Expressing disappointment with the jail authorities, the court complained to the jail superintendent and said that he had turned the matter into a joke.
During the hearing, Advocate Shoaib Shaheen informed the court that the political leadership was unable to meet for the past five months. Justice Sardar asked the Adiala Jail Superintendent, asking if he had been told why he had been summoned.
Superintendent Abdul Ghafoor Anjum replied that he was out of the city. Justice Sardar further inquired why the meeting was not organized last Friday. The jail official said the PTI founder did not want to meet anyone that day.
The judge also raised concerns over the previous court order, and asking why Yusufzai was made to wait in the superintendent’s office instead of facilitating the meeting.
The jail superintendent replied that PTI founder and his wife, Bashara Babi, have said that Yusufzai is neither his lawyer nor his main person.
The court then asked Yousafzai about the cases in which he is the PTI founder’s lawyer.
“How many cases do you have in the Peshawar High Court? And what do you stand as a lawyer?” He asked.
Meanwhile, a list of six lawyers appointed by the PTI founder was presented to the court, which had signed it. The jail superintendent informed the court that PTI founder and Bashra Bibi is allowed to meet every Tuesday.
The court then adjourned the hearing till Wednesday (March 19).
