The federal government on Saturday introduced the 27th Constitutional Amendment Bill in the Senate, proposing major reforms to the country’s judicial system and military command structure.
After the approval of the Cabinet – chaired by Prime Minister Shehbaz Sharif from Azerbaijan in practice, the bill was tabled in the Upper House and immediately referred to the Standing Committee on Law and Justice for review.
Law Minister Prime Minister Nazir Tarar, who introduced the bill in the House, described the 27th Amendment as a long-standing agenda in the context of the Charter of Democracy. Tarar said that this work cannot be completed at the time of the 18th amendment.
Amendment of Article 243
The amendment proposes several changes to the Constitution, including in Article 243, which states that “the Federal Government shall have control and command of the armed forces” and “the supreme command of the armed forces shall vest in the President”, among other things.
According to a draft available with Geo News, the amendment seeks to abolish the post of “Chairman Joint Chiefs of Staff Committee” (CJCSC) and introduce a new title, “Chief of Defense Forces”.
The amendment bill also proposes that honorary titles such as field marshal, marshal of the air force, and the lifetime status of admiral of a fleet awarded to senior military officers in recognition of their services.
The Law Minister told the Senate that the amendment would only empower Parliament to change the titles of field marshals, marshals of the air force, and admirals of the fleet to impeach them.
The Prime Minister will appoint the Commander of the National Strategic Command from the Pakistan Army on the recommendation of the Chief of Defense Forces.
Establishment of Federal Constitutional Court
The amendment also proposes the establishment of a Federal Constitutional Court and final reduction in the powers of the Supreme Court. It has attempted to transfer some constitutional authorities from the Supreme Court to the Federal Constitutional Court.
According to the draft, the president and prime minister will play a central role in appointing judges, while parliament will be empowered to determine the number of judges to serve on the proposed federal constitutional court.
The amendment also sought to curtail the powers of the Supreme Court, transferring some constitutional functions to the new court, where all provinces would enjoy equal representation. The Chief Justice of the Federal Constitutional Court will serve a term of three years.
