On Saturday, a federal judge stopped US President Donald Trump from deploying 200 Oregon National Guard troops to Portland, while a case challenging the move is being tried.
In Portland, US District Judge Crane Emarjat’s decision is a blow to Trump because he wants to send the army to the cities that he calls lawless to the objections of his democratic leaders.
The immigrant, which was appointed by Trump during his first term, prevented the Republican president from sending troops by at least October 18, there is no evidence that the recent protests reached the level of uprising or seriously interfered with law enforcement agencies.
When Trump termed the city a “war-torn”, lawyers from the Oregon Attorney General’s office said that the protests in Portland were “small and ridiculous”, which resulted in only 25 arrests in mid-June and no arrests in 3-1/2 months since June 19.
The Emergut wrote, “The president’s determination was merely unreasonable with the facts.
The Trump administration filed a notice of appeal to the 9th US Circuit Court of Appeals based in San Francisco.
White House spokesman Abigil Jackson said, “President Trump, using his legal powers to protect federal assets and personnel in Portland, after law enforcement riots and attacks – we expect it to be ratified by a high court.”
Portland’s Mayor Keith Wilson said at a press conference that his city was peaceful and “this story was created.”
President is sending troops to the democratic -led cities
Trump has already sent the National Guard to the Police Los Angeles and Washington DC, saying he will send troops to several other cities. Earlier on Saturday, a Democrat, Illinois Governor JB Pratzkar said in a social media post that Trump was preparing to send 300 National Guard troops to Chicago on his objections.
The Portland case was filed on September 28 by Democratic Oregon Attorney General Dan Ray Field, a day after Trump said he would send “domestic terrorists” to Portland to save federal immigration facilities.
Oregon asked the court to declare the deployment illegal and prevent it from moving forward, saying that Trump is exaggerating the threat of protests against his immigration policies to justify the state national guard units illegally.
The Oregon case states that Trump announced the deployment of the army in Portland in Portland after showing video clips from “large and more turbulent demonstrations”.
The state argued that the deployment of Trump violates several federal laws and the state’s sovereign right, which is in favor of the police for its own citizens. According to the legalization, the decision to send the troops to “defuse” democratic cities like Portland, such as Trump’s Portland, violates the rights of the state under the 10th Amendment of the US Constitution.
The judge says Trump cannot ignore the facts on the ground
The Emergut said on Saturday that Oregon’s own arguments are likely to succeed that Trump illegally called the National Guard and violated Oregon’s rights under the 10th Amendment.
Emergott wrote that although the president should be “widely respected” in military decisions, Trump cannot ignore the facts on earth. He added that accepting Trump’s legal arguments would mean that he could “send military troops anytime anytime” at any time “and” the danger of fading the line between civil and military federal power – could harm this nation. “
This is the latest legal challenge for the deployment of Trump for the deployment of military forces in Democratic -led cities, including Los Angeles and Washington, Washington, DC, which he says he is suffering from enmity with crime and immigration.
State and local democratic leaders have disagreed with the claims, accusing Trump of prolonging US laws and principles against the use of the military for domestic law enforcement.
A federal judge stopped the Trump administration on September 2 from using the military to fight crime in California, but following the decision during the administration’s appeals.
Washington, DC’s Democratic Attorney General on September 4 filed a lawsuit on September 4 to end the deployment of National Guard troops in the country’s capital. A judge has not yet ruled the request.
