ISLAMABAD: The Supreme Court on Thursday approved its bail applications in eight cases of May 8.
The decision was announced by a three-member bench, chaired by Chief Justice of Pakistan (CJP) Justice Yahya Afridi and consisted of Justice Hassan Azhar Rizvi and Justice Mohammad Shafi-who filed a PTI founder against his bail plea by the Lahore High Court.
The LHC had rejected the Prime Minister’s bail plea in separate cases related to the May 9 riots in June, including the attack on the Jinnah House in Lahore.
The PTI founder, who has been behind bars for two years, transferred the SC against the LHC decision that the first Information Report (FIR) lacked considerable evidence and blamed the allegations of his involvement in the riots baseless.
Khan’s petition said that he was in the custody of the NAB at the time, it was impossible for him to participate in these riots, besides raising doubts about the matter based on “contradictions” in the prosecution’s statements.
In addition, the appeal tried to further investigate the matter, as he was suspected of Mala Fed’s intention to refrain from arrest for five months, and he termed the police delayed statements as incredible and emphasized that he deserved the right to bail.
During today’s hearing, Chief Justice Afridi asked Prosecutor Zulfar Naqvi about the evidence against the suspect, after which the latter said that the three witnesses have testified against Khan, as well as the availability of photography and voice matching tests.
Naqvi said, “WhatsApp messages are also available,” he added that the trial court has approved various tests but the suspect did not cooperate.
“Would be a legal response [for this]Why are you saying that just going in your favor, “CJP Afridi replied.
“Do not find the results from the Supreme Court. [proceedings]”The top judge gave remarks, while further instructed the officer to find results from the trial court instead.
Prosecutor Naqvi has claimed that the evidence associated with the suspect, Justice Rizvi, questioned whether any investigation was made after his arrest was granted on May 14 and whether he had cooperated with the authorities.
“The main character of the PTI founder is in all [May 9] Cases, “emphasized the prosecutor.
Meanwhile, politician’s lawyer Salman Safdar said that the challan was not presented against Imran in the eight cases – which he said was named in only three FIRs and was absent from the remaining five.
Note that if the SC observed any qualities of the case, the trial would be affected, CJP Afridi announced a verbal decision to accept the PTI founder’s bail plea in May 8, 9 cases.
