KARACHI: A retired professor, Loyate University of Medical and Health Sciences (Lums), continues to work as Vice-Chancellor (Pro-VC) of Jamshoro, despite clear legal restrictions and a Supreme Court decision, except for such appointments. He was initially appointed to the post on August 30, 2024 for a four -year period. However, under the decision of Sindh Universities and Institute Rules and the Supreme Court of 2013, he abandoned the position after his retirement.
According to the Sindh University’s Rules (Amendment) Act 2013, Section 13, the only serving university professors are eligible to appoint the Pro-VCS. The Act states: “The Vice -Chancellor will be a famous educational and a prominent medical professional appointed by the Chief Minister of the University.”
In addition, the original petitions number 89/2011 and 175/2011, and the Supreme Court decision in the Civil Review Petition No. 193/2013, is clearly prohibited from the restoration of retired officials in any department or continuous services. As a result of the Apex Court decision, about 2,000 2,000 officials were removed in various departments in Sindh, including members of 69 university staff from professors to lower level officers.
In compliance with the decision of the Supreme Court and Sindh Universities (Amendment) Act 2013, several retired Pro VCs were removed in Sindh. For example, in May 2022, Professor Dr. Ghulam Sarwar Gachal was removed from his post as a supporter of Mohrma Benazir Bhutto Shaheed University Campus when he reached the age of retirement.
Similarly, in January 2020, eight retired professors were removed from the duties of their supporters VC in various institutions across the province, they were under the direction of Sindh Chief Minister Syed Murad Ali Shah. These removal were in accordance with both the rules of the amended university and the Supreme Court’s decision.
The list included Looms’s Dr. Munir Ahmed Junjo, Jamshoro. Dr. Aslam Pervez Memon of Sindh University, Noshro Foz Campus; Dr. Khawari Jamali of Dow University of Health Sciences; Dr. Zarnaz Waheed of Dow University, Karachi; Dr. Kartar Deewani of Dow University, Karachi; People’s University Dr. Shamsden Shiya, Shaheed Benzir Abad. Jinnah Sindh Medical University Dr. Lebana Ansari, Karachi and Dawood Engineering University, Dr. Roshan Dean Rashidi of Karachi.
Senior educationist Professor Yaqub Chandio described Professor Naz’s permanent rule as a direct denial of the illegal and high court decision.
“If the Supreme Court has clearly ruled that a retired officer can continue to be restored or even in his position, then such a continuation, especially in high offices like Pro VC, is not only a violation of the law but also a dangerous view,” said the market.
Despite these legal obstacles and ideas, Professor Naz has not been released for formal retirement or removal from his supporter VC position. He is currently the only retired professor in Sindh who serves in such a role.
When contacted, Looms Vice -Chancellor, Jamshoro Dr. Ikram Ojan briefly told the news that according to his opinion, Professor Naz’s supporter was a continuation of legal and laws. He added, “Pro-VC’s position is a period of employment that cannot be affected by retirement.”
Professor Dr. Sima Naz also commented on the matter and defended his posting. She believes in her pro -Vice -Chancellor’s notification that she should continue for four years and her retirement from her job has nothing to do with her current posting. Dr. Naz claimed that despite the retirement of professors, there were many views of the continuity of service.
A spokesman for Chief Minister Sindh Abdullah Rasheed Chana told the news that the issue of continuing the job of Dr Naz will be investigated in light of the decision of the Act and Apex Court related to the Pro-VC and action will be taken according to the law.
Chanana said that the Sindh government and the Chief Minister strongly believe in transparency and rule of law and no one will be allowed to hold any position in contradiction of the law.
