ISLAMABAD: After the Judicial Commission of Pakistan (JCP) on Monday, six judges of the provincial high courts were extended to the Supreme Court. Two senior SC judges.
According to a press release issued today, a meeting was held under the chairmanship of Chief Justice of Pakistan (CJP) Yahya Afridi to consider the nominations for the appointment of High Court judges in SC. The Chief Justice of all the High Courts, except the Lahore High Court (LHC), was among the six judges. They included Justice Muhammad Hashim Khan Kakar, Justice Muhammad Shafi Siddiqui, Justice Salahuddin Panwar, Justice Ashtiaq Ibrahim, Justice Shakeel Ahmed and Justice Aamir Farooq.
The Commission also nominated Justice Miangol Hassan Aurangzeb of IHC as an acting judge of the Supreme Court through the majority of its total membership.
Last month, the Judicial Commission re -appointed its meeting from February 11 to February 10 to consider filling eight vacant posts of judges in the Supreme Court.
The JCP, which approves judicial appointments, was formed to include four parliamentarians under the 26th Constitutional Amendment, which led to several changes in the judiciary.
Today’s meeting was boycotted by PTI barrister Gohar Ali Khan and Senator Ali Zafar, and two SC judges, Justice Mansoor Ali Shah and Justice Muneeb Akhtar. The chairman of the PTI said that the meeting should be postponed until the 26th Amendment was decided.
Earlier, two members of the commission, including Justice Shah and Justice Akhtar, had requested the postponement of the meeting. Moreover, in his letter, Zafar also asked CJP Yahya Afridi to leave the meeting.
Talking to reporters today, Barrister Gohar said that PTI filed petitions against the 26th Amendment, which are still pending. However, since the meeting was not postponed, the PTI chose not to take part.
Barrister Zafar, for his part, also maintained that the meeting should be delayed until the issue of seniority is resolved. He added that the issue of seniority is also pending, but his concerns have not been resolved.
Barrister Gohar said, “PTI has already outlined its future process style,” he added that he fully supported the lawyers’ protest.
He reiterated, “Our objection was that the meeting should be postponed until the 26th Constitutional Amendment was decided.” However, the vote was held on this objection, and the majority decided to move forward in the meeting, he regretted.
The story of the judges’ transfer
Earlier this month, the Judicial Commission sought nomination from all the high courts, in which a list of five senior judges of each of them was requested.
Islamabad High Court (IHC) initially sent the names of three judges – Chief Justice Aamir Farooq, Justice Mohsin Akhtar Kayani and Justice Miangol Hassan Aurangzeb – because the other two judges, Justice Tariq Mehmood Jahangri and Justice Babar Sattar less. Didn’t reduce Five years of service.
However, the Lahore High Court’s Justice Sarfraz Dougar, along with two judges of the SHC and BHC, were recently shifted to the IHC. After his transfer, the IHC administration reviewed his seniority list and nominated him as a senior poise judge. Therefore, his name was sent to the JCP.
Following the story of the transfer, five IHC judges raised the issue of judges’ sanity and sent represented the IHC Chief Justice against the new seniority list and sent a copy of it to CJP Afridi.
The judges argued that any transfer judge should take a fresh oath under Article 194 of the Constitution, which would place them under the IHC seniority list. This will make him disqualified for the post of IHC Chief Justice immediately.
